This Acceptable Use Policy ("AUP") governs Customer's use of FlexOps services, including the FlexOps Ship Manager platform and Gateway API (collectively, the "Services"). By using the Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account.

1. Prohibited Activities
Users may not use the Services to:
1.1 Illegal Activities
- Commit fraud, misrepresentation, or any illegal activity
- Misuse shipping labels or create fraudulent shipments
- Violate any applicable local, state, national, or international law or regulation
1.2 Security Violations
- Upload, transmit, or distribute malware, viruses, or other harmful code
- Attempt to gain unauthorized access to any system, network, or account
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or any related system, network, or data
- Perform any form of network scanning, probing, or monitoring without authorization
1.3 Service Abuse
- Resell, sublicense, or redistribute the Services without explicit written permission from FlexOps
- Use the Services for timesharing or service bureau purposes
- Reverse engineer, decompile, or disassemble any part of the Services
- Overload or attempt to overload the Services through excessive API calls or other means
1.4 API-Specific Abuse
If you use the Gateway API, the following additional restrictions apply:
- Free-tier quota abuse — Use a free Developer plan as a free address validation, rate calculation, or tracking microservice without a proportional relationship to label generation activity
- Multi-account circumvention — Register multiple Workspaces across different accounts or domains to circumvent API call budgets or label quotas
- Rate limit evasion — Use techniques such as IP rotation, distributed request patterns, or credential cycling to evade rate limits or abuse detection systems
- Carrier integration reverse engineering — Attempt to extract, replicate, or independently access underlying carrier APIs by reverse engineering API requests or responses
- API key misuse — Expose secret (
sk_) or live (live_) API keys in client-side code, public repositories, browser JavaScript, or mobile applications - Automated scraping — Systematically extract data from the API for purposes unrelated to your shipping operations

1.5 Content Restrictions
- Transmit, store, or process any content that is illegal, harmful, threatening, abusive, or violates any third party's rights
- Use the Services to send spam, unsolicited messages, or communications
- Impersonate any person or entity or falsely state or misrepresent affiliation with any person or entity
2. Data & Privacy Obligations
2.1 Data Accuracy
Customers must:
- Provide accurate, current, and complete information when using the Services
- Maintain and update account information to ensure it remains accurate
- Ensure all shipping data, including addresses and recipient information, is accurate and valid
2.2 Sensitive Data
Customers must:
- Avoid storing or processing restricted sensitive data (such as payment card data, social security numbers, or health information) unless expressly permitted by FlexOps and in compliance with applicable laws
- Comply with all applicable data protection laws, including GDPR, CCPA, and other privacy regulations
- Obtain all necessary consents and authorizations before processing personal data through the Services
2.3 Data Responsibility
Customers are solely responsible for:
- The content and accuracy of all data submitted to the Services
- Ensuring they have the right to process and transmit any data through the Services
- Compliance with all applicable laws regarding data collection, processing, and storage
3. Security Practices
3.1 Account Security
Customers must:
- Maintain secure passwords and authentication credentials
- Not share account credentials with unauthorized parties
- Immediately notify FlexOps of any unauthorized access or security breach
- Use strong, unique passwords and enable multi-factor authentication when available
3.2 Access Controls
Customers must:
- Implement reasonable safeguards to protect access to their account
- Restrict access to authorized personnel only
- Regularly review and update access permissions
- Monitor account activity for suspicious behavior
3.3 Compliance
Customers must:
- Comply with all applicable shipping, logistics, and transportation laws and regulations
- Comply with all applicable data protection and privacy laws
- Maintain appropriate records as required by law
- Cooperate with FlexOps in any security investigation or audit
4. Enforcement
4.1 Violation Consequences
FlexOps reserves the right to:
- Investigate any suspected violation of this AUP
- Suspend or terminate accounts that violate this AUP
- Remove or disable access to any content that violates this AUP
- Report violations to law enforcement authorities when appropriate
4.2 Notice and Appeal
FlexOps will typically provide notice before suspending or terminating an account, except in cases of:
- Immediate security threats
- Illegal activity
- Violations that could cause harm to FlexOps or other users
Customers may appeal enforcement actions by contacting FlexOps support.
4.3 No Refunds
Suspension or termination of an account due to AUP violations does not entitle the Customer to any refund of fees paid.
